Merger Agreement

The following is the 1947 Merger Agreement between the Gulfport-Carnegie Library
and the Harrison County Library

ORDERED by the Board that the Agreement between the Gulf port, Carnegie Library and Harrison County Rural Library be tiled and spread upon the Minutes, viz:

AGREEMENT

WHEREAS, the Library Board of the Gulfport Carnegie Library of the City of Gulfport, Mississippi, hereinafter called the Carnegie Board, and the Board of Trustees of the Harrison County Library, hereinafter called the County Board, desire to combine library facilities, and each participate in the facilities of the other in order to provide more adequate library service for the people of the City or Gulfport and Harrison County,

NOW, THEREFORE, it is agreed between the Carnegie Board and the County Board, as follows:

1. This Agreement shall be effective for planning and organizational purposes and to permit adoption of a budget for the fiscal year beginning October First, 1947, on the First day of July, 1947, and shall be and become completely operative for operational and all other purposes on the First day of October, 1947, which latter date shall be hereinafter referred to as the effective date of this agreement, provided it is executed by both said Boards and by the authorized officials Of the City of Gulf port and Harrison County, Mississippi.

2. The name of the combined library shall be the "gulfport carnegie-harrison county library."

3. The Carnegie Board agrees to house the books, book repair equipment, furniture and other facilities of Gulfport Carnegie-Harrison County Library, for use by white persons, in the present library building, and to house the books, furniture aid other facilities of the negro branch in a building now or hereafter located on Block 118, Original Gulfport, in the City of Gulfport, Mississippi, owned by said City.

4 (a). There shall be an executive committee who shall have charge of the maintenance and operation of the Gulfport Carnegie-Harrison County Library in the interim between the joint meetings of the Carnegie Board and the County Board and subject to the action of the said Boards jointly, with the further duty of employing minor personnel, and appointing and employing, subject to the approval of the joint Boards, a Chief Librarian who shall have a Library Science degree from a recognized library school, and a Librarian who shall be a trained Librarian with Library Science training from a recognized college.

(b). The Executive Committee shall be composed of five members all of whom shall be members either of the Carnegie Board or the County Board; two of whom shall be selected from the Carnegie Board by that Board and two of whom shall be selected from the County Board by that Board, and the fifth member shall be selected, for a term of one year, by the four selected from the two Boards, and to be selected from either of said Board provided the fifth member first to be selected shall be a member of the Carnegie Board and the next year from the County Board, alternating annually thereafter.

(c). The Executive Committee shall hold monthly meetings on the second Friday in each month. A quorum of said Committee for transacting business shall be three or more, provided there must be at least one member from both the Carnegie and County Boards present.

5. The Carnegie Board and the County Board shall consist of five members each and said boards shall have a joint meeting, quarterly, on the second Friday of the months of July, October, January and April of each year.

6 (a). There shall be a budget prepared by the joint Boards and submitted to the City of Gulfport and Harrison County, Mississippi, for approval for the operation of the Gulfport Carnegie-Harrison County Library, for the fiscal year beginning October 1, 1947, and ending September 30, 1948, and annually thereafter for each fiscal year beginning each October 1st.

(b). The City of Gulfport will appropriate one-third of the approved budget of the Gulfport Carnegie-Harrison County Library which one-third shall include the amount annually appropriated by Harrison County for the Gulfport Carnegie Library for books, pursuant to the provisions of Section 6631 and/or Section 2998, Mississippi Code of 1942, and Harrison County will appropriate two-thirds of the amount of the approved budget for the Gulfport Carnegie-Harrison County Library; all to take care of all operating expenses and minor repairs and upkeep in connection therewith; providing Harrison County shall appropriate, in addition to the amounts aforesaid, all funds necessary for major repairs to the book-mobile and/or replacement of the book-mobile; and providing further that items of major repairs for buildings shall be appropriated 50% by the City of Gulfport and 50% by Harrison County.

7. Books from the Gulfport Carnegie-Harrison County Library shall be available for circulation, reference and any other proper library use, as provided by Title 24, Chapter 3, Volume 5, Mississippi Code of 1942, as amended.

8 (a). Either the Carnegie Board or the County Board. may terminate this agreement and cause a division to be made of the jointly operated properties on any October 1st, provided notice of such decision to terminate is given to the other Board and to the respective governing bodies of the City of Gulfport and Harrison County, Mississippi, on or before July 1st of such year in which termination is desired to be effected.

(b). Upon the effective date of such termination, as herein above provided for, the books, furniture and equipment which were owned by the Carnegie Library and by the County Library on September 30, 1947, shall be taken by each as the property of the said Libraries respectively; the book-mobile or any replacement thereof shall be and remain the property of the County Library; and all books, furniture and equipment purchased for the Gulfport Carnegie-Harrison County Library on and after October 1, 1947, and on the termination date possessed by the joint library shall be, as nearly as may be, divided. equally between the Carnegie Library and the County Library, taking into consideration the cost and types of books, furniture and equipment each would on termination be possessed of, to the end that each said library would have a well balanced and complete library and equipment therefor.

The above and foregoing agreement is hereby approved, ratified and confirmed by the City of Gulfport, Mississippi, and by Harrison County, Mississippi.
